objective
A senator is accused of violating the Code of Conduct for public officers. Describe the procedural steps by which the Senate may discipline the senator, and explain how the judiciary can review the Senate's decision.
Answer Options
A.
The Senate may delegate the matter to a special tribunal that decides by a three‑quarters vote, and the senator can seek review in the Supreme Court, which can only remand the case for a new vote.
Correct Answer
B.
The Senate investigates via its Ethics Committee, the committee recommends action, the full Senate votes (requiring a two‑thirds majority to suspend or expel), and the senator can seek judicial review in the Federal High Court, which can uphold or overturn the Senate's decision based on procedural fairness.
C.
After the Ethics Committee reports, the full Senate votes requiring a simple majority to expel, and any challenge must be brought before the Court of Appeal, which can only review constitutional issues.
D.
The Senate's Ethics Committee conducts an investigation, then the committee alone can suspend the senator by a simple majority, and the senator has no right to judicial review.
